The sister of a man accused of killing Cash App founder Bob Lee has had drunk driving charges against her dropped, two weeks after she was arrested for crashing her $150,000 Mercedes.

Khazar Momeni, 38, the wife of plastic surgeon Dino Elyassnia, was arrested on November 27 in San Francisco's Tenderloin neighborhood. She was seen driving to a run-down smoke shop, where she and a young man bought two cans of N20 – popular party inhalants made from nitrous oxide and known as whippets, hippie crack or nitrous oxide. When the gas is inhaled, it can cause a quick wave of euphoria.

Momeni drove away from the store and side-swiped several cars before crashing. The can of 'whippet' was on the front seat of her car, next to her designer handbag, when she was arrested.

Witnesses told DailyMail.com that she was shaking and visibly high.

She was charged with two counts of hit-and-run, accusing her of failing to provide proof of insurance and driving within her lane.

But on Monday, prosecutors announced they would not file charges.

“The charges against her are being dropped at this time pending further investigation,” the San Francisco District Attorney's Office said.

“While charges against Ms. Momeni have been dropped, the investigation continues and charges may be filed at a later date.”

Prosecutors have not yet received a toxicology report for the incident, the office said.

Dismissal of charges due to delays in the blood toxicology report is “very common and not unusual,” the agency spokesperson said.

Momeni's brother Nima, a technology entrepreneur, has been arrested and charged with Lee's murder.

Surveillance video of Lee's last night shows him entering the large Millennium Tower apartment complex in downtown San Francisco, where Khazar Momeni lives.

Video footage shows Lee and Nima Momeni leaving the building together shortly after 2 a.m. and driving away in Nima Momeni's car.

Lee was found shortly after 2:30 a.m. in San Francisco's Rincon Hill neighborhood, where there are tech offices and apartments but little activity in the early morning hours.

Prosecutors have said the stabbing occurred after Nima Momeni confronted Lee about his relationship with his sister, demanding to know if the two had used drugs together.

He has pleaded not guilty.
