Diddy strikes back against $100 million default judgment… claiming he never received the lawsuit

Just days after Diddy was hit with a massive $100 million default judgment, the music mogul is attempting to appeal the judgment.

Derrick Lee Cardello-Smith sued the 54-year-old rapper for $100 million, alleging he was drugged and sexually assaulted at a party in 1997.

Because Diddy did not formally respond to the lawsuit or attend a virtual hearing held on Monday, the judge entered a default judgment against the rapper.

Starting October 1, Diddy would have to pay Cardello-Smith $10 million a month.

However, Diddy filed an emergency motion on Thursday to have the judgment overturned, claiming, among other things, that he never received the summons.

Documents from the music mogul show he was at a loss as to how to handle the matter after news outlets began reporting on it.

His lawyers strongly deny that anything went wrong. According to them, the accusations are ‘prima facie unlikely and completely fabricated’.

The attorneys also argue that even if the allegations were true, the statute of limitations on those charges has already expired 17 years ago.

Diddy’s team claims the lawsuit is frivolous because the man filing the lawsuit is a convicted rapist and that he has a history of filing frivolous lawsuits.

The lawsuit alleges that Cardello-Smith and Diddy both had sex with a group of women at a party in 1997. He claims that at one point he felt Diddy’s hand touching his buttocks.

He also claims that Diddy spiked his drink and that when Diddy woke up, he was having sex with another woman. He allegedly said, “I did this to you too.”

Cardello-Smith, who is currently serving a prison sentence in Michigan, filed a restraining order against Diddy in August.

He produced documents showing that Diddy had visited him in jail and claimed he had offered Cardello-Smith $2.3 million to drop the allegations against him.

He also claims that Diddy poisoned his drink and that when Diddy woke up, he found himself having sex with another woman and that he said, “I did this to you too.”

Diddy allegedly told the inmate, “You know how we behave,” after he refused to drop the charges, though Cardello-Smith responded, “I don’t agree with the way you behave.”

Diddy’s lawyer Marc Agnifilo told DailyMail.com: ‘This man [Cardello-Smith] is a convicted felon and sexual abuser, who has been convicted of 14 counts of sexual assault and kidnapping in the past 26 years.

“His resume now includes committing court fraud from prison, as Mr. Combs has never heard of him, let alone filed a lawsuit. Mr. Combs looks forward to having this verdict dismissed quickly.”

Last month, Combs filed a motion to dismiss a $30 million lawsuit filed by music producer Rodney “Lil Rod” Jones, who had accused him of persistent groping and possible drug-induced rape.

Jones filed the lawsuit in February, just weeks before two of Combs’ homes were searched by federal agents as part of a sex trafficking investigation.

Jones alleged that he was instructed to recruit prostitutes and have sex with them for the star’s pleasure. He has hundreds of hours of video footage documenting Combs’ “serious illegal activities.” Diddy has denied all allegations of wrongdoing.
