A new lawsuit against former Minneapolis police officer Derek Chauvin has accused him of using excessive force against a woman just months before the killing of George Floyd.
On Tuesday, Robins Kaplan LLP filed a complaint in Minnesota federal court seeking $9 million in damages against Chauvin and his former partner, Ellen Jensen.
The suit alleged that in January 2020, about five months before George Floyd’s death, a woman named Patty Day was “forcibly ripped from her car” and thrown to the ground by Chauvin and Jensen.
Chauvin then allegedly placed his knee on Day’s back as she lay there in handcuffs — the same position he would infamously hold for about nine minutes during his encounter with Floyd.
On Tuesday, Robins Kaplan LLP filed a complaint in Minnesota federal court seeking $9 million in damages against Derek Chauvin and his former partner, Ellen Jensen.
Day says the excessive force used against her left her with “significant” arm and shoulder injuries, as well as a broken tooth.
All the while, Jensen did nothing to intervene, the complaint said.
It continues to claim that the city of Minneapolis was aware that officers within its police department had a history of “unnecessary use of excessive force.”
In the press release accompanying the company’s filing of the complaint Tuesday, Day said, “Unfortunately, my experience with Derek Chauvin is not unique.”
“George Floyd died at the hands of this individual, and if the city had intervened in his behavior after my interaction, he could still be alive today… It was a traumatic part of my life that I hope no one else experiences will have to endure. .’
Day is seeking $9 million in compensatory damages, in addition to punitive damages, an amount to be determined by a jury.
Several years ago, former officer Chauvin was convicted of second-degree murder for Floyd’s killing, an incident that plunged the country into a summer of riots and protests in the name of racial justice.
Chauvin is currently serving a 22-year prison sentence.

Last spring, the Minneapolis City Council agreed to settle two civil cases against Chauvin for nearly $9 million.
Both lawsuits alleged that the former law enforcement officer used excessive force several years before Floyd’s death, including one involving a 14-year-old.
The eight-figure settlement came two years after the city approved a historically large $27 million settlement with Floyd’s family.
Late last year, Chauvin was reportedly stabbed in jail.
