Delta Airlines passenger arrested after forcing himself on a flight attendant, kissing him
A Delta Airlines first class passenger was arrested after being accused of forcing himself on a male flight attendant and kissing him on the neck.
David Alan Burk, 61, was flying from Minnesota to Alaska to settle his late friend’s estate when he reportedly got “wasted” on a Delta Flight 517 on April 10.
Burk told the flight attendant he was “so beautiful” before asking for a kiss. When the man refused, Burk reportedly grabbed him and planted a kiss on his neck.
He is said to have become ‘snippy’ when he was denied a glass of red wine and managed to smash the captain’s tray later in the flight.
The flight attendant, referred to only as TC in the court documents, had to be moved to the back of the plane for the remainder of the six-hour journey while other cabin crew tended to Burk.

Burk had ordered a glass of red wine before boarding, as is allowed for first class passengers, but became frustrated when TC did not serve him the drink before departure due to the flight’s arrival.
After leaving, TC preferred to give Burk his drink, but while picking up trays he became wary of Burk, who was “shaking his hand.”
Ten minutes later, Burk approached TC at the gallery and told him he was “so beautiful” before asking him, “Can I have a kiss?”
TC replied, “No, thank you,” but Burk didn’t take no for an answer, grabbing the flight attendant by the neck and telling him, “Okay, then by the neck.”
“While the plane was in the air, BURK grabbed TC’s neck, pulled him towards BURK, and purposefully kissed TC’s neck,” the declarationobtained by the Daily beaststated.
The flight attendant said he felt “very uncomfortable” and was “baffled” by the bold move. As Burk headed for the bathroom, he looked over his shoulder at TC and said, “I’ve got one of those Delta cards for you.”
Delta cards are given to “frequent flyers to give to Delta flight attendants who the frequent flyers feel deserve to be recognized and rewarded for their good work.”
Attendants can redeem the cards for rewards, such as higher flight status when flying as a passenger with Delta.
TC told investigators he thought the compliment was “sincere,” but that Burk’s “actions and behavior escalated so quickly.”
TC went to the back of the plane to tell his colleagues about the encounter and only returned to first class after Burk reclaimed his seat on 5A.
When they returned to the front of the plane, other flight attendants informed TC that Burk had “broken the plane captain’s meal tray and plate.”
TC then contacted the captain, who was identified only as JS. The captain later informed his crew member that he had contacted Airport Dispatch about the incident and that this was a ‘level two security threat’ and that a flight attendant would need to switch roles with TC.
A flight attendant who switched seats with TC said the man was “wasted” and had drunk three glasses of red wine during the flight. Burk later denied it, saying he only drank one glass, served by TC, before falling asleep. He was committed to the Anchorage Correctional Complex and released on his own authority on April 13
‘[TC] was uncomfortable with the situation and asked to be moved to the back of the plane to put distance between him and him [Burk],” JS said in a statement to investigators.
However, other flight attendants also “didn’t feel comfortable” serving Burk and one refused to switch places for fear of what he might do to her. Another female attendant would eventually switch places with TC.
As the flight progressed, Burk downed two more glasses of red wine and was “wasted” before falling asleep, a flight attendant told TC, according to the affidavit.
Upon arrival in Anchorage, Burk was taken into custody by airport police and read his Miranda rights. While speaking to investigators, he denied ever getting up to use the restroom, but had confirmed that TC was his flight attendant and his only flight attendant.
However, he denied drinking three glasses of red wine, saying he only drank the first one TC served him after takeoff and slept for the rest of the flight.
When asked if he’d kissed the flight attendant, he said he’d “never kissed anyone.” He also said he “didn’t even eat on the flight” and denied breaking the tray because he “couldn’t remember going to the bathroom on that flight.”
He then told investigators that he had consumed “a lot” of alcohol prior to the flight, but claimed to have had just one glass of red wine on the plane from Minneapolis to Anchorage. He also refused to take a breathalyzer test because he did “nothing wrong.”
Burk also told investigators that he was in Anchorage to handle his friend’s estate, as he was executor and his friend had died the previous week.
He asked the police, “Do you know who I am?” They did not.
He was committed to the Anchorage Correctional Complex and was released on his own authority on April 13.
