A teacher who was fired after sending a ‘reply all’ email and traveled to Bali while on sick leave has had a major victory.
Stanislaw Kosiek was released from Marist Ashgrove College in Brisbane on August 9 before taking the case to the Queensland Federal Court.
The case was withdrawn after a month and Mr. Kosiek took an ‘early retirement’ in September, marking the end of his 22-year tenure at the school.
Mr Kosiek had accidentally sent a ‘reply all’ email criticizing his bosses in February.
The school later expressed concern that he had traveled to Bali on holiday despite the fact that he was on sick leave and unable to attend to his ‘normal work duties’.
Federal Court Judge Berna Collier sided with Kosiek and said in an interim ruling that he had made clear his intention to travel to the holiday destination.

“Recently, IT leadership has been less than adequate,” the email said.

Two days after sending the email, Mr. Kosiek sent a follow-up retracting his comments, but within a week he was removed from the payment.
According to court documents presented by Mr. Kosiek, he was actually fired for criticizing his superior in an email he accidentally sent to the entire faculty instead of his union manager.
