Austrian officials announce update on Josef Fritzl’s advancing dementia – as the incest monster’s lawyer fights ‘untenable’ new restrictions placed on him

Austrian incest monster Josef Fritzl is placed under guardianship due to his advancing dementia, the Krems Public Prosecutor’s Office reports.

Fritzl’s lawyer, Astrid Wagner, said she plans to challenge the process under which the court will appoint another person to act on behalf of the 89-year-old because he is deemed incapable of making decisions for himself.

Usually this is done to prevent abuse of the data subject by another party, but Wagner claims that the appointment of an adult representative to manage Fritzl’s affairs is ‘not sustainable’.

Although Fritzl has “incipient dementia and delusions,” a representative is neither necessary nor warranted as he has no business to conduct and no property, the attorney said.

It comes after Wagner revealed last month that delusional Fritzl had told her to look for a new home in the country – despite judges recently denying him the hope of parole due to his ‘unprecedented’ criminality.

The depraved rapist fathered seven children with his daughter Elisabeth, while he kept her as a sex slave in the basement of the parental home.

The 89-year-old, who was given a life sentence in 2009, was recently transferred from a high-security hospital wing for the criminally insane in Stein to a regular prison.

The transfer, based on a decision by a three-member panel of the Krems Regional Court, became legally binding at the end of May.

In mid-May, a decision was also made on a general parole from normal prison to freedom.

The authorities determined that this was “not possible for special preventive reasons,” according to Austrian media.

They added that given the “unprecedented criminal energy associated with the convicted crimes,” it cannot be assumed that “future freedom from crime” will be guaranteed.

Fritzl will be on probation for ten years in regular prison, meaning he may be sent back to the higher security facility.

The regional court ruled earlier in January that Fritzl no longer posed a threat to society and could therefore be transferred from a high-security prison to a normal prison.

This decision was later seen as the first step in a process that could lead to the Fritzl being fully released from prison.

Prosecutors subsequently opposed the lower court’s decision, and the Vienna Supreme Court ruled that “the facts necessary for such parole had not yet been fully clarified.”

The Vienna Regional Court ruled that the Krems District Court had made the wrong decision and that Fritzl still had the potential for aggression and thus still posed a danger.

But in April, Fritzl’s lawyer managed to convince the Krems court that her client is entitled to the full benefits of Austrian justice, including release from a high-security prison if he is not dangerous.

A hearing on psychiatric and medical findings was held on April 30, on the basis of which the court found that: “As a result of extensive, progressive dementia and physical deterioration, the inmate’s combined personality disorder, which necessitated his admission, has been ‘buried’.” in such a way that the danger to the prisoner is reduced and no criminal offense with serious consequences is expected.’

Fritzl’s horrific crimes, including rape, coercion and imprisonment, sent shockwaves throughout Austria and Europe in 2008.

Elisabeth, whom he abused from the age of 11, disappeared in 1984 at the age of 18.

For more than twenty years, Fritzl kept his daughter captive in a cramped and moldy cellar beneath his house in Amstetten, which he had built himself.

He raped his daughter thousands of times over many years, the abuse resulting in the birth of seven children, three of whom remained in captivity with their mother.

One died at the hands of Fritzl, a matter of days after birth. He threw the body into an incinerator.

The discovery of his sickening crimes only occurred when one of his daughters became seriously ill, forcing him to seek medical attention.

Fritzl was tried in March 2009 on a gruesome litany of charges, including murder, rape and slavery, and given a life sentence.
