Aussie driver is slugged with $410 fine after her passenger made a very simple mistake

An Australian motorist was fined $410 after her front seat passenger was caught not wearing her seat belt properly.

The costly error was spotted by a mobile detection camera on a road in Sydney.

The camera captured the woman wearing the belt under her arm instead of over her shoulder.

This simple mistake cost the female driver hundreds of dollars in lost driving and also resulted in three penalty points.

She took to social media to express her frustration at the punishment for this minor infraction, admitting it was a “costly lesson.”

“I think the fine should be passed on to the passenger, but the law says it is the driver’s responsibility,” the woman wrote.

Passengers over the age of 16 can also be given an on-the-spot fine if the police catch them not wearing their seat belt correctly.

This year in NSW more than 11,400 fines have been issued to drivers and passengers for not wearing a seat belt.

About 75 percent of the fines were issued to drivers who were not wearing their seat belts properly.

Violations noted included sharing child seats with adults and not wearing child seats.

Since July 1, mobile phone detection cameras have been used across NSW to enforce the state’s seat belt laws.

On November 29, 2023, the state government passed legislation to implement the new measure.

Approximately 29 drivers are killed and 76 seriously injured each year in NSW due to not wearing a seat belt.

The offence also carries significant penalties, with drivers in Queensland facing a whopping $1,209 fine and four penalty points.

Drivers in Western Australia also face hefty fines, with the offence carrying a fine of up to $600.

Penalties for seat belt violations

New South Wales

Drivers can be fined up to $410 and given three demerit points for the violation.

QLD

Motorists in the Sunshine State face as much as $1,209 in fines if a passenger 16 years or older is not wearing a properly adjusted and fastened seat belt.

Victoria

Drivers will receive three penalty points and a $395 fine for this violation.

Tasmania

This violation carries a fine of $390 and the driver will receive three penalty points.

South Australia

Motorists will face a $435 fine and three demerit points.

Western Australia

Drivers will be fined $600 and given four penalty points.

Northern Territory

This violation is punishable by a $500 fine.
