Ariana Madix and Katie Maloney are battling former Something About Her chef Penny Davidi Borsuk over the sandwich shop’s trademark after she filed a lawsuit against them over their failed “partnership.”
The Vanderpump Rules stars parted ways with Penny, a chef who was named COO/Director of Culinary at Something About Her, ahead of its grand opening in May 2024, after a financial dispute.
But before she was fired, Penny and her attorney husband Jonathan Lee Borsuk filed for the trademark Something About Her in August 2023 through her company Put A Fork In It LLC. They reportedly had the approval of both Madix and Maloney to do so.
Although Chef Penny no longer works for Madix and Maloney, he still owns the pending trademark.
Something About Her was published in the May 28, 2024 issue of The official trademark sheet — provide everyone with the opportunity to object within 30 days of the publication date, before a notice of approval is issued, in accordance with the Guidelines.
And now DailyMail.com can exclusively reveal that Madix and Maloney took on Chef Penny by filing an objection through their lawyer on June 25.

The reality TV stars were also given a 90-day extension to appeal.
A few weeks later, on July 9, Madix and Maloney’s attorney filed a new trademark for Something About Her.
Documents show that in addition to the restaurant, the business partners also plan to offer Something About Her fragrances, candles, phone cases, bags/tote bags, clothing and even catering services.
These latest details in the Something About Her saga come less than a week after Chef Penny Maloney and Madix filed a lawsuit, according to TMZ.
Penny claims that Madix and Maloney failed to honor the business agreement they had made regarding her role at the restaurant.
PEOPLE reports that Penny accuses the duo of not adhering to the terms of their written “collaboration.”
Penny claims she was guaranteed a 10% partnership in June 2023 if she helped develop and operate the restaurant.

Despite no longer working for Madix and Maloney, Chef Penny has retained ownership of the pending trademark Something About Her; Maloney and Madix will be seen in May
She claims that, thanks to this agreement, she has done a significant amount of work to get the restaurant up and running, including filing trademarks for the eatery.
Penny claims she was supposed to receive a salary of $7,500 per month until January. In January, her compensation would increase to $10,000 per month.
Now, however, Penny claims that Madix and Maloney deny ever having any such collaboration with her.
She now hopes that the judge will uphold the terms of the agreement and that she will be fairly compensated.
Something About Her finally premiered in West Hollywood in May 2024, after two years of unexpected delays.
In April, Maloney announced that she and Madix were no longer working with Borsuk.
“No, we are no longer working with Penny,” she said on the podcast Popping Off with Teddi Mellencamp and Emily Simpson.
While she didn’t say much about the departure, she said the partnership ultimately wasn’t the best match.

“You know, we loved working with Penny, and Penny was great, but ultimately it wasn’t the right fit,” Maloney said.
Borsuk, the chef, has also worked with Lisa Vanderpump, Madix and Maloney’s former employer.
Penny worked with Lisa on both Pump Lounge and TomTom.
On her website she states that she works as a culinary specialist and New Business Manager for Sysco Foods.
