A New Mexico teen accused of murdering her newborn in a hospital bathroom was first seen in court on Tuesday.
Alexee Trevizo, 19, sat behind her lawyer during the court’s virtual appearance as he discussed the details of her upcoming trial, during which she will plead her innocence.
Her lawyer Gary Mitchell agreed that the trial would take place on October 2.
The teen gave birth in the bathroom of Artesia General Hospital on Jan. 27 after complaining of back pain.
After delivering her infant son alone, she put his body in a garbage can for cleaners to find.

Prosecutors say she killed him by strangling him, basing their theory on the fact that the baby had air in his lungs when he died.
She claims the baby was stillborn, and her lawyers now claim that hospital staff killed the baby by giving Trevizo drugs such as morphine.
Trevizo has not spoken publicly since she was charged, but her lawyer Gary Mitchell told DailyMail.com that she has been unfairly slandered.
“The fact is, she didn’t kill her baby. The tests (that have been done) to determine if she did are so outdated it’s medieval.
“There was no strangulation. This is not a murder case,” he said.
Mitchell says he will show how Trevizo was given a cocktail of drugs unsuitable for pregnant women, let alone women in labor.
“This was certainly the primary cause of the baby’s death. Guess what causes major breathing problems in fetuses? Morphine,’ he said.
Mitchell says a toxicology report shows the baby had 0.19 nanograms of morphine in his system when he was born, and that he also tested positive for COVID-19, influenza A&B and SARS.
He claims that Trevizo did not know she was pregnant, despite gaining weight and developing a bump that was clearly visible through her cheerleading attire.
However, as DailyMail.com previously reported, Trevizo’s high school friends claimed she knew she was pregnant.
