New Mexico judge upholds conviction of armorer Hannah Gutierrez-Reed over Alec Baldwin’s shooting of Halyna Hutchins on Rust set

A judge has upheld an involuntary manslaughter conviction against a movie gun maker in the fatal shooting of a cameraman by Alec Baldwin.

Gun cop Hannah Gutierrez-Reed asked a New Mexico court to throw out her conviction or call a new trial, claiming prosecutors failed to share evidence that could have exonerated her in the shooting on the set of the western film ‘Rust’.

But Judge Mary Marlowe Sommer noted in her written order that Gutierrez-Reed’s attorneys had not shown there was a reasonable possibility that the outcome of the trial would have been different had the evidence been available to her.

The judge also denied a request by Gutierrez-Reed for her release, denying the request for a new trial.

Marlow Sommer halted and terminated Baldwin’s trial in July, citing police and prosecutor misconduct and their withholding of evidence from the defense in the 2021 shooting of cameraman Halyna Hutchins on set outside Santa Fe.

Baldwin, the lead actor and co-producer of “Rust,” was pointing a gun at Hutchins during a rehearsal for a film set outside Santa Fe when the revolver went off, killing Hutchins and wounding director Joel Souza.

A jury convicted Gutierrez-Reed of involuntary manslaughter in March in a trial overseen by Marlowe Sommer, who later sentenced her to a maximum of 18 months.

Gutierrez-Reed has an appeal of the conviction pending in a higher court. Jurors acquitted her of charges that she tampered with evidence in the “Rust” investigation.

Prosecutors accused Gutierrez-Reed of unknowingly bringing live ammunition onto the set of “Rust” and failing to follow basic gun safety protocols.

Evidence that Gutierrez-Reed’s attorneys say was not shared included a firearms expert’s report on the functionality of the gun Baldwin used, ammunition that was later turned in to authorities and an interview with “Rust” ammunition supplier Seth Kenney .

Defense attorneys did not immediately respond Monday to an email seeking comment on the judge’s decision.

Gutierrez-Reed has pleaded not guilty to a separate charge of carrying a gun into a bar in Santa Fe, New Mexico, where firearms are prohibited.

A proposed plea deal awaits court review.

Gutierrez-Reed is currently serving her sentence at the Santa Fe County Adult Detention Facility.

Baldwin, meanwhile, saw his involuntary manslaughter case dismissed in July.

The judge at the Santa Fe, New Mexico, court said at the time that errors had been made by the prosecutor in the handling of evidence, which she said “affected the fundamental fairness of the case.”

The decision came after a daylong hearing without the jury present over bullets that should have gone into evidence, which Baldwin’s lawyers claimed were “hidden” from them and “buried” in another file.

The issue had disrupted the trial of Baldwin, who pleaded not guilty to two counts of involuntary manslaughter as he was charged with negligence.
