New York Republican Rep. Claudia Tenney sent a letter to Attorney General Merrick Garland demanding he “initiate proceedings” to impeach President Joe Biden under the 25th Amendment after a bombshell report alleging mental health issues of Biden had emphasized.

The Justice Department on Thursday released its long-awaited investigation into Joe Biden’s mishandling of classified documents, delivering a scathing assessment of the president’s “diminished capabilities” and limited memory.

Special prosecutor Robert Hur described him as “a likeable, well-meaning, elderly man with a poor memory,” and that “it would be difficult to convince a jury to convict him” of withholding classified documents.

He ultimately recommended no charges be filed against Biden, sparking outrage among conservatives over a “double standard” as Donald Trump faces 40 criminal charges over his own mishandling of classified material.

Tenney wrote a letter to Attorney General Merrick Garland on Thursday stating that the report’s “alarming” findings indicate that Biden “should be charged” unless he is “mentally incompetent to stand trial.”

Garland should “initiate proceedings to impeach the President under the 25th Amendment to the United States Constitution,” Tenney said in the letter obtained by DailyMail.com.

The 25th Amendment, which outlines presidential succession, gives the vice president and the Cabinet the power to remove the commander in chief from office through a majority vote if it is determined that he or she is no longer fit for office.

“It is extremely concerning that he cannot remember what position he held, and when,” she further referred to Hur’s account that Biden could not remember when he was vice president.

“It may be even more frightening not to be able to remember when your child died, even within the span of a few years.”

According to Hur, Biden had difficulty remembering when his son Beau died during an interview as part of the investigation.

However, Tenney’s letter is just one blow in a salvo of Republican demands that Biden be impeached on the 25th following Hur’s report.

“That (report) does not describe someone who should be the commander-in-chief of our armed forces and the defender of American freedoms,” Sen. Rick Scott, R-Fla., wrote on X in response to the report. “It’s time for his administration to invoke the 25th Amendment.”

Scott on Thursday became the first top elected official to call for using the Constitution to impeach the president.

Rep. Marjorie Taylor Greene, R-Ga., also renewed his call to use the 25th Amendment to impeach Biden.

“The Special Counsel’s report showing that Joe Biden’s mental decline is so severe that he cannot stand trial means he is unfit for office,” she wrote on X.

“We must demand that the 25th Amendment be invoked or face impeachment,” the GOP continued.

Another House Republican, Mary Miller of Illinois, similarly called on Biden’s administration to take action.

“For the security of our nation, Joe Biden must resign. He couldn’t remember basic facts about his life,” she says posted on X. “He is not qualified to remain as commander in chief and every day he stays he puts America at risk.”

“If he doesn’t want to resign, the government should invoke the 25th Amendment.”

Republican Senator Josh Hawley of Missouri also chimed in: write on X that it’s “time for the 25th Amendment.”

Following the report, Biden decided to hold a hasty press conference on Thursday evening to undermine claims about his mental state.

‘I know what I’m doing! My memory hasn’t gotten any worse. My memory is fine. Look what I’ve done since I became president,” he said indignantly.

“Nobody thought I could get through the things I was given. How did that happen? I guess I just forgot what was going on….”

The president later answered a question about the humanitarian situation in Gaza.

Biden botched the answer and the identification of a world leader, naming Egypt’s Abdel Fattah El-Sisi the president of Mexico.

Former President Trump, meanwhile, is facing a 40-count indictment over his handling of classified documents at his Florida home, Mar-a-Lago. Trump pleaded not guilty to all charges in June.

Trump faces decades in prison if convicted, and special prosecutor Jack Smith – the lead prosecutor in the case – recently interviewed additional witnesses to strengthen his case against the former president.

The Republican-led House Judiciary Committee posted on X that the decision was a ‘double standard’.

“Special Counsel Robert Hur recommends no criminal charges against President Biden in classified documents case. “Despite Hur’s acknowledgment that Biden deliberately retained and disclosed classified material after his vice presidency when he was still a private citizen,” the committee wrote.

House Intelligence Committee Chairman Mike Turner, R-Ohio, also rejected Hur’s recommendation.

“There is clearly a two-tiered justice system within Attorney General Merrick Garland’s Department of Justice,” he wrote.

“President Biden has deliberately hoarded classified information from his decades in the Senate and his time as vice president, but Special Counsel Robert Hur has decided not to recommend charges against him.”

House Judiciary Chairman Jim Jordan, R-Ohio, wrote: “Today’s report from Robert Hur tells us two things: There is a double standard of justice in this country. And Joe Biden is not fit for office.”

Even Trump’s political rival, Nikki Haley, said the double standard between Biden and Trump’s cases was “glaring.”

“Both Joe Biden and Donald Trump were reckless with classified documents,” the presidential hopeful wrote.

“If Biden defends old age and forgetfulness, Trump can easily make the same claim. Trump needs to hire Biden’s lawyers quickly.”
