Jamie Foxx DENIES sexual assault allegation after woman sued star over claims he ‘rubbed her breasts’ while intoxicated after she asked to take a photo with him in 2015

Jamie Foxx has denied sexual abuse allegations after the star was sued over an alleged incident in 2015.

In a new lawsuit obtained Wednesday by DailyMail.comthe 55-year-old Oscar winner was accused of putting ‘both hands’ on a woman’s waist before moving them ‘under her top’.

The accuser, identified only as “Jane Doe,” claimed he “began rubbing her breasts” after “pulling her by the arm toward the back of the roof” at Catch NYC & Roof.

She further claimed that the ‘intoxicated’ star told her ‘she looked like Gabrielle Union’ and touched her in her private parts.

A spokesperson for Foxx denied the allegations in a statement to DailyMail.com, saying: ‘The alleged incident never occurred. In 2020, this person filed a nearly identical lawsuit in Brooklyn.

‘That case was dismissed shortly afterwards. The claims are no more viable today than they were then.

“We are confident that they will be discharged again. And once it does, Mr. Foxx intends to file a claim for malicious prosecution against this individual and her attorneys for refiling this frivolous action.”

In her lawsuit, the plaintiff claims the incident happened around 1 a.m., a few hours after she and a friend were sitting at a table away from him at the celebrity hotspot.

According to the lawsuit, “the plaintiff’s friend asked Foxx if he wanted to take a picture with her and the plaintiff” and he allegedly replied, “Sure, honey, anything for you.”

She claims he “seemed drunk at the time” and told her that “she looked like Gabrielle Union.”

Additionally, the accuser claimed that he told her, “Wow, you have that supermodel body” and that she smelled “so good.”

After he allegedly had physical contact with her, the accuser says she “attempted to step away and noticed a security guard and others who saw what had happened,” but says they “chose to walk away.”

The accuser says things quickly escalated and claims he “put his hand down her pants and placed his fingers on and inside her vagina and anus.”

When her friend saw what allegedly happened, the prosecutor said her friend ran toward her and “Jamie stopped touching her.”

The plaintiff claims to have sought medical treatment and suffered both pain and emotional distress “as a result of the ‘assault, assault, battery and battery.’

She is suing Foxx and Catch and their employees for compensatory and punitive damages.

The suit was filed under New York’s Adult Survivors Act, which established a one-year window for filing sexual abuse claims that would otherwise be barred by the statute of limitations.

The deadline for filing such claims ends Thursday.

At the time of the alleged incident, he was dating actress Katie Holmes, whom he divorced in May 2019 after six years of dating.

He was previously accused of sexual misconduct after a woman claimed he hit her “with his penis” in 2002.

In 2018, Las Vegas police confirmed to People that a “female victim came to the LVMPD alleging that a sexual assault had occurred in the Las Vegas area in 2002” and that Foxx was “named as a suspect.”

At the time, Foxx’s attorney released a statement to the outlet denying the claims.

“Jamie Foxx emphatically denies that this incident ever occurred, and he will file a report against the woman with the Las Vegas Police Department for filing a false report against him,” Foxx’s attorney said. “The first time Mr. Foxx became aware of this woman’s absurd claims about an incident that allegedly occurred sixteen years ago was when TMZ contacted his representatives today about this story.”

The lawyer added: ‘The alleged incident was not reported to police in 2002, or at any other time in the last sixteen years until last Friday, because the incident never happened. We believe it is extremely reckless for any publication to publish this fake story.”

The charges come seven months after he suffered an unspecified medical emergency in April that left him hospitalized for months.

In August, he revealed to fans that he is “finally starting to feel like himself again” after his health problems.

While speaking to his 16.8 million Instagram followers at the time, he talked about going on “an unexpected dark journey.”

Despite the challenges in his recovery, the artist said he can “see the light” and is “grateful to everyone who has reached out and sent well wishes and prayers.”

“I have a lot of people to thank… you just don’t know how much it meant… I’ll thank you all personally… and if you didn’t know… GOD IS GOOD… all day, every day,” he concluded.

The update came less than a month after Foxx gave his first detailed update on how he’s doing since being released from the hospital.

Foxx let fans know he’s not “blind” or “paralyzed” in an emotional three-minute recording about his health.

‘I experienced something I never thought I would experience. I know a lot of people [were] I was waiting or wanting to hear an update, but to be honest, I didn’t want you to see me like this,” he admitted with tears in his eyes.

The actor, who returned to work last month to film a commercial in Las Vegas, continued, “I want you to see me laugh, have fun, party, make a joke, make a movie, [or] a television program.’

“I didn’t want you to see me with the tubes running out of my body and I was trying to figure out if I was going to make it.”

The father-of-one added that he has been through “hell and back” to survive and has experienced some “potholes” on his “road to recovery.”

The Beat Shazam host also praised his sister, Deondra Dixon, and daughter, Corinne, 29, for “saving” his life and keeping the details surrounding his hospitalization private.

“To them, to God, to a lot of great medical people, I leave this video for you,” Foxx added. “I can’t tell you how amazing it feels to see your family step in like that, and you all know they kept it airtight, they didn’t let anything out, they protected me, and that’s what I hope everyone could do that. have in moments like these.’

He then showed how his ‘eyes work fine’ by moving them back and forth, before clarifying that he is ‘not paralysed’.

Speaking directly to fans, he said: ‘I just want to say I love everyone and all the love I have.’

The actor got choked up as he warned, “From now on, if you see me and burst into tears every now and then, it’s only because it’s been hard, man. I was sick, dude. But now I’ve got my legs under me, so you’re going to see me out.’

“Man, I know on videos they talk about people crying… but I’m not gonna do a take two, it is what it is,” he mused. “Like I said, I want you to remember me for the jokes I make and the movies I make – some good, some not (I think I have a good one out), and songs I sing.”

‘I am here on earth because of some wonderful people. I’m here on earth because of God, man,” the artist concluded. “I’m on my way back.”

Foxx captioned the video, “Thank you to everyone…it’s been a long road but all the prayers, amazing people and God got me through.”

In July it was reported that the star was in “amazing form” as he resumed his work commitments, an insider said TMZ.
