A businessman who allegedly elbowed his girlfriend in the face and knocked her unconscious is allowed to walk free on bail after the video was played in court.

Marco Furia, 42, had spent three weeks in jail on charges of two assaults causing actual bodily harm and was previously refused bail at Waverly Magistrates Court in Sydney on June 20.

But that changed when the NSW High Court was shown CCTV footage from the lobby of the apartment in Bondi where the alleged incident took place.

“The footage completely contradicts the fact sheet,” Furia’s attorney Paul McGirr told the court. Daily telegram reported.

“My client was never the aggressor and there is no record of Ms. Veraldi’s repeated physical contact with him, which is evident.”

The CCTV footage shows Rossella Veraldi grabbing Mr. Furia from behind several times in an attempt to push and drag him out of the building through an open glass door.

She then appears to push Furia against the lobby wall before Mr. Furia reportedly turns around and punches her in the face with his right elbow.

Police claim she was knocked unconscious by the blow which was described as a ‘punch’.

Mrs. Veraldi falls to the floor with her head in her hands as Mr. Furia walks away.

Finally she gets up, walks out the glass door and lies down on the floor outside the building.

A few seconds later, Mr. Furia went outside and squatted on a step in front of the apartment building.

Ms Veraldi was later seen outside the building wearing only jeans and a bra and police were called to where they arrested Mr Furia.

Mr McGirr told the court that his company almost went bankrupt while he was in prison and that ‘if not for the CCTV footage it probably would have still been there’.

Furia will appear in court again on September 26.
