Olivia Wilde and her ex-fiancée, Jason Sudeikis, won a major victory in their former nanny’s wrongful termination lawsuit against them.

On Wednesday, Ron Zambrano, representing plaintiff former nanny Ericka Genaro, confirmed to DailyMail.com that a judge has ruled that the case should be referred to arbitration.

“We don’t agree with the decision, but it is what it is and now we’re going to litigate it in arbitration and the case will move forward. This does not end the lawsuit. It just changes the location,” Zambrano explained.

The Los Angeles attorney continued, “As for the underlying facts, we have text messages and testimony that she was forced to quit and then summarily fired anyway. We have a lot of confidence in the case, so instead of taking this to court, we’re taking it to arbitration and we’re ready to move on.”

This comes six months after Genaro claimed in legal documents that she was fired by the couple when she applied for medical leave.

In her lawsuit, filed in Los Angeles County Superior Court, she stated that her doctor ordered her three days of medical leave in 2021 to deal with the stress of the couple’s public breakup.

After informing Sudeikis, she claimed in the lawsuit that he “fired her on the spot.”

The couple have vehemently denied the allegations.

Genaro has claimed overdue payment, damages and attorney’s fees.

But the former celebrity couple quickly hit back at Genaro’s claims, calling them “false and rude.”

They reiterated that claim in a statement to DailyMail.com about Genaro’s lawsuit, saying, “As parents, it is incredibly distressing to hear that a former nanny of our two young children would choose to make such false and egregious allegations in public. express about us.
