An Oklahoma mom sued her daughter’s school district after her 15-year-old was assaulted in the bathroom by a transgender student, whom the school claimed was unaware of being a biological male.

Theresa Gooden said her daughter, who is identified only as EG in the $75,000 lawsuit, suffered “beating” from the 17-year-old transgender student in October.

“It’s quite traumatizing. It wasn’t just a fight, it was a beating,” Gooden said Fox and friends first.

The student, who was assigned male at birth, was legally prohibited from being in the girl’s restrooms as Oklahoma law prohibits it. The southern state requires people to use the restroom associated with the gender listed on their birth certificate.

However, Edmond Public Schools superintendent Angela Grunewald said the unidentified student was listed as female in the school system.

“In high school, birth certificates are not required to attend school. So there was no birth certificate in the (student) file to verify in one way or another’, she says in a video.

“If a parent comes in and enrolls their child as a certain gender, and if you look at that child by all social norms, they look and present themselves as that gender, you wouldn’t question that.”

However, Gooden and her attorney Greg Andrews claim that EG informed the school that the transgender student had previously threatened her and that the student was male. In addition, according to Fox and Friends, the student was searched for weapons by the police.

“They knew firsthand at the time that there was a chance it was a boy based on what my client’s daughter said,” Andrews told the outlet. “The police report shows they had a paternity affidavit in the student file identifying the boy as male. So the school is just lying, and they didn’t comply. I can’t wait for us to be found out in this, because it will clearly show that they broke the law.’

The mother, who said her daughter is emotionally traumatized by the attack, said: “It’s not OK. That was a brutal attack on my daughter for not following the guidelines. I expect my daughter to be safe at school.’

Gooden is seeking damages in excess of $75,000 from the district and payment of her costs. The lawsuit also says the transgender student had “confided” in her daughter that “he was, in fact, a male student who identified as a woman.”

EG claims she notified deputy director Maryjel Cochrane of the conversation, but court documents claim nothing was done.

In addition, the lawsuit states that the alleged assailant, who was born male, was removed from the school by police after threatening the teenage girl with a weapon on Oct. 21.

In a statement, the school said: ‘As this matter is pending, little can be said about it at this time. However, Edmond Public Schools is confident that when the facts are presented, it will be determined that the district has fully complied with the law and acted in a reasonable manner.”
