Last month, Baldwin and film gunsmith Hannah Gutierrez-Reed were charged with manslaughter in the death of cinematographer Halyna Hutchins, which halted production on Rust in October 2021.

Baldwin is alleged to have shot Hutchins while rehearsing a scene in a church and Gutierrez-Reed is said to be responsible for making sure the gun was not loaded with live bullets.

Both deny any wrongdoing and are due to appear in court in New Mexico on February 24 for their arraignment.

The troubled low-budget movie is scheduled to resume shooting in the spring with a mix of new and old crew members.

The scene being rehearsed when Hutchins was shot will be rewritten, a lawyer for Rust Movie Productions said. the hollywood reporter. Production has also moved from New Mexico to California.

Plans to complete the film were first announced in October, after a deal was struck that gave Matthew Hutchins, the dead woman’s widower, a share of the film’s profits and an insurance payout. Hutchins’ parents and sister are still suing Baldwin.

Filming will resume with heightened security protocols, including a team of security supervisors and a ban on the use of any operable weapons.

It’s unclear if Gutierrez-Reed will return.

Director Joel Souza, who was wounded in the shooting, will return.

“Although it’s bittersweet, I’m grateful that a bright and dedicated new production team joining the previous cast and crew is committed to completing what Halyna and I started,” Souza said, according to The Hollywood Reporter.

“All of my efforts on this film will be dedicated to honoring Halyna’s legacy and making her proud. It is a privilege to carry this out on her behalf.

Baldwin has vowed to fight the charges. He has repeatedly stated that he did not pull the trigger and said it was a tragic accident, emphasizing that he relied on hired firearms experts to be on set.

In a probable cause affidavit, prosecutors say Baldwin was absent from an initial firearms training session.

Gutierrez-Reed set up an hour-long post session for Baldwin, but they only completed 30 minutes.

“According to Reed, Baldwin was distracted and on a cell phone with his family during training,” prosecutors said.

The affidavit claims that Baldwin gave “inconsistent accounts” about how the shooting occurred: He first told police that he “fired” the gun, and then insisted that he did not pull the trigger.

Prosecutors claim that “photos and videos clearly show Baldwin, multiple times, with his finger inside the trigger guard and on the trigger.”

They add: “Baldwin reached out to responding officers on the day of the shooting, wanting to speak to them because he was the one who ‘fired’ the gun.”

They state: ‘Photographic and video evidence from inside the church on the day of the shooting shows part of the trial up to and including moments before the shooting.

“Photos and videos clearly show Baldwin multiple times with his finger inside the trigger guard and on the trigger, as he manipulates the hammer and draws, aims and holsters the revolver.

“Baldwin knew that the first rule of gun safety is to never point a gun at someone you do not intend to shoot,” the document continues.

In a statement, Baldwin’s lawyer, Luke Nikas, said: “This decision misrepresents the tragic death of Halyna Hutchins and represents a terrible miscarriage of justice.”

‘Mister. Baldwin had no reason to believe that there was a live bullet in the gun, or anywhere on the film set,” Nikas added.

‘He trusted the professionals he worked with, who assured him that the weapon did not have live bullets. We will fight these charges and we will win.’

SAG-AFTRA, the union that represents approximately 160,000 actors and other professional entertainers, also opposed the charges.

“The death of Halyna Hutchins is a tragedy, all the more so for its preventable nature. It is not a dereliction of duty or a criminal act on the part of any artist,” the group said in a statement.

“The prosecutor’s assertion that an actor has a duty to ensure the functional and mechanical operation of a firearm on a production set is incorrect and uninformed.

‘An actor’s job is not to be an expert in firearms or weapons. Firearms are provided for use under the guidance of multiple skilled professionals directly responsible for the safe and accurate operation of that firearm.

“In addition, the employer is always responsible for providing a safe work environment at all times, including hiring and supervising the work of trained weapons professionals.”
