A high-profile Australian who has been accused of rape met his alleged victim at a nightclub and had sex with her three times.

Daily Mail Australia can reveal that the couple allegedly returned home and had sex once that night and then twice in the morning.

The woman alleges that on the last two occasions the sex was not consensual because he did not use a condom.

The man cannot be named under a Queensland law that prohibits the identification of those accused of alleged sexual assault or rape offenses unless the case goes to trial.

He was charged on January 10 for the alleged October 2021 incident in Toowoomba, west of Brisbane, Queensland.

The high-profile man met the alleged victim at a nightclub, before having sex three times.

It will be alleged in court that the couple spoke on Snapchat for a few days after the encounters, but soon lost contact.

She then approached the police and said she only consented to sex on the condition that he used a condom.

The alleged victim stated that she was not wearing one during the second and third times they had sexual intercourse.

Not using a condom without the partner’s permission is considered sexual assault under Queensland law.

The man’s case was mentioned in Toowoomba Magistrate Court on January 11, but the defendant did not appear in person because he was on the interstate.

Magistrate Kay Ryan demanded to know why the man did not appear in person. ‘They have given him notice to appear, why isn’t he here?’ she asked.

The man’s defense attorney, Rowan King, pushed for certain bail conditions and turned over medical documents while asking for a continuance.

The police did not challenge his bail conditions, which included a no-contact order and the surrender of his passport.

Ms. Ryan ordered that a brief of evidence be served by February 15. The man will return to summons court for incarceration on February 22.

Last year, the second Hear Her Voice report was delivered, highlighting the experiences of women and girls throughout the criminal justice system.

The report made 188 recommendations, including educational campaigns aimed at dispelling rape myths, among others.

One of the key recommendations was the ability to name people accused of sexual offenses in Queensland, bringing it in line with other states and jurisdictions.
