A woman who admitted having sex with a then 13-year-old boy – who called her “mom” – and then having his child has been sentenced to three months in prison.

Andrea Serrano, 31, of Fountain, Colorado, was sentenced Thursday. It comes after she was initially released on $70,000 bond shortly after her original arrest in July 2022.

Fountain police had charged Serrano with sexual assault of a child by someone in a position of trust at the time, as well as child molestation. Investigators said Serrano admitted to the relationship.

In March, it was widely reported that Serrano’s lawyers had come to a plea deal with prosecutors that would force her to register as a sex offender, but mean she would avoid jail and face probation until May.

Now she must serve 90 days in jail and still have to meet the original terms of the plea deal. The terms include ten years to life on intensive probation under the supervision of sex offenders.

Since her arrest, Serrano has given birth to the teen’s baby. The child is under her care. His family plans to petition the court for custody. The victim is now 14 years old.

Serrano was first questioned by police after a therapist found out and came forward with the allegations. After being interviewed by Fountain police, Serrano confessed to her crimes.

An affidavit failed to confirm the exact relationship between the couple, but said Serrano took the position of surrogate mother, with the teen referring to her as “mother.”

He looked at her as a maternal figure and even referred to her as ‘mom’ before, according to the criminal statement in the case, quoted by the Colorado Springs Gazette.

“I feel like my son has been robbed of his childhood. Now he has to become a father. He is a victim and he will have to live with that for the rest of his life,” said the victim’s mother. KKTV after the plea deal was made public.

“I feel like if she was a man and he was a little girl, it would definitely be different. They would look for more. I feel like because he’s not a woman, they aren’t. They feel sorry for her,” she added.

At her arrest KOAA reported that Serrano and her victim lived together for a while.

The town of Fountain is located just south of Colorado Springs.
