A 31-year-old Colorado woman won’t see the inside of a prison cell despite admitting to having sex with a 13-year-old boy in June 2022.

Later it was learned that Andrea Serrano had become pregnant as a result of the sexual assault on the minor. She was released shortly after her original arrest in July of last year on $70,000 bail.

The Fountain Police Department had charged Serrano with sexual assault of a child by someone in a position of trust, as well as sexual assault of a child. Investigators said Serrano admitted to the relationship.

On Friday, it was widely reported that Serrano’s lawyers had reached a plea deal with prosecutors that will force her to register as a sex offender, but means she will avoid prison.

Since her arrest, Serrano has given birth to the teen’s baby. The child is in her care. Her family plans to petition the courts for custody. The victim is now 14 years old.

Serrano was first questioned by police after a therapist found out about it and filed the allegations. After being interviewed by the Fountain Police Department, Serrano confessed to his crimes.

“He looked at her as a mother figure and even called her ‘mom’ before,” according to the criminal affidavit in the case, cited by the Colorado Springs Gazette.

‘I feel like my son has been robbed of his childhood. Now it’s his turn to be a father. He is a victim and he will have to live with it for the rest of his life,’ the victim’s mother said. KKTV after the plea agreement was made public.

“I feel like if she was a guy and he was a girl, it would definitely be different. They would be looking for more. I feel like because he’s not a woman, they’re not. They are having compassion for her,” he added.

At the time of his arrest, KOAA reported that Serrano and his victim had been living together for a while.

The victim’s actual mother told the Gazette that she spoke to the judge in the case before the plea deal was accepted to express her dissatisfaction.

The KKTV report says Serrano’s plea deal is for lesser charges and that a judge could still sentence her to 10 years to life on “intensive supervised probation for sex offenders.”

Serrano faces a hearing in May that will determine the length of his probation.

The Gazette reports that the “misdemeanor charge” is one of incest, a class four felony in Colorado.

Before his parole hearing, Serrano is also due in court in March and faces two additional misdemeanor charges for violating the terms of a restraining order.

The city of Fountain is located just south of Colorado Springs.
